The Legal Age Requirement
Under the Smokefree Environments and Regulated Products Act 1990 (as amended), the minimum age to purchase or be supplied vaping products in New Zealand is 18 years old. Only those aged 18 and above, unless otherwise restricted by other existing regulations, are allowed to purchase vapes, and only after undergoing an age verification process.
This restriction applies nationwide and reflects a global standard for the legal age requirement on these products. It isn't limited to consumers either: retailers, both physical and online, are mandated by law to follow protocols ensuring they don't sell products to anyone under 18. Even as a gift or on behalf of someone else, anyone under 18 is not allowed to purchase vape and tobacco products.
Online Age Verification
Since online retailers can't physically check ID, the Ministry of Health requires online sellers to verify a buyer's age before completing a sale. A simple checkbox confirming someone is 18 or over isn't sufficient, since anyone, including someone under 18, can tick that box. In fact, a checkbox alone doesn't stand as a legal defence in court if a sale to a minor occurs.
In general, this is how online stores verify a buyer's age:
- ID documentation (passport, driver's licence, etc.) is required at sign-up or before checkout.
- Third-party verification services are employed to confirm age.
- Age is confirmed again at the point of delivery, where whoever receives the package must verify their age.
Physical Store Requirements
Physical stores are bound by the same rules. Specialist vape retailers (SVRs), approved stores that can sell a wider range of vaping products and flavours, must take all practicable steps to prevent anyone under 18 from even entering their stores. This can include signage on age restrictions, staff checks, and ID checks at the point of entry and point of sale.
Penalties
The New Zealand government takes this age requirement seriously. Retailers can face significant fines if proven to have sold a vape product to a minor. Failing to verify age, even if the buyer turns out to be 18 or older, can still mean penalties for the retailer. Specialist vape retailers can also face penalties if there's proof minors were allowed to enter their premises at all. For serious or repeated offences, a retailer's licence can be revoked by the government.
The General Public's Role
The government encourages the general public to report any violations of this legal age requirement. If someone believes a seller, online or physical, is selling products to minors, they can report it to the Ministry of Health. This age requirement may sound simple, but neglecting it can lead to serious consequences.
